Michael Cohen's Sentencing Memorandums

Michael Cohen's Sentencing Memorandums

Cohen had two Sentencing Memorandums filed on Friday (12/7/2018). One was from the Special Counsel/Mueller investigation into Russian interferance in the 2016 US presidential election, here: https://www.documentcloud.org/documents/5453418-Mueller-Cohen-filing.html The sentencing memo says that Cohen lied to the House and Senate investigations and also to the Special Counsel investigators about Russian interferance into the 2016 election, and about the Trump Tower Moscow plans. It notes that the Mocow project was under negotiation with high level Kremlin staffers during and after Trump's election, while Russia was also interfering with our election, that Trump was aware of these things, and that Trump and all those in his orbit hid their knowledge of this meddling and project from voters (leaving him/them subject to blackmail). Page 4 of the memo appears to say that Trump asked Cohen to arrange a personal meeting with Putin about Trump Tower Moscow while Putin would be in New York in September of 2015 for a UN General Assembly meeting. It also says that Cohen has provided a "detailed account" of his and others "outreach" to Russia, details of Russian individuals "outreach" to Trump to provide "synergy" to the Trump campaign and also regarding Trump's business interests, including attempts to arrange meetings with, and getting Putin's personal approval for, the Trump Tower Moscow project, the Trump Busines organization's role, Cohen's White House communications regarding these topics, and Cohen's coordinating with everyone involved to keep this secret from the public. This Sentencing Memorandum does not recommend any particular prison time for Cohen, but asks that the judge sentencing Cohen consider how helpful and cooperative Cohen has been with the Special Cousel Investigation and to consider running any prison terms concurrently. The details are stunning in revealing the level of deceit and make it clear that Trump was directly involved, but is overall generous to Cohen. The second Sentencing memorandum is from the Southern Distrct of New York and covers tax evasion, false bank statements, false statements to Congress, and illegal campaign contributions. This document recommends "a substantial term of imprisonment". https://assets.documentcloud.org/documents/5453395/USDOJ-Cohen-20181207.pdf This document is much less generous to Cohen. It states that Cohen has displayed a "marked" pattern of criminality throughout his professional life for which he now desires "leniency" from the judicial system. It points out that even now Cohen publicly claims to be cooperating, but that he is not. This reports says that although Cohen already enjoyed a life of "wealth" and "privilege", that his "greed" and "ambition" and his link to Trump led him to commit even more criminal acts over many years. This memo provides a lot of detail about Cohen's criminal activities- the taxi medallions, using his connection to Trump to sell useless "consulting" services, tax evasion that allowed him to avoid paying 1.4 million dollars in taxes, the details of the many bank frauds, and the illegal campaign contributions (the hush money payoffs to McDougal and Daniels), amongst other things. They recommend that the sentencing judge consider "51 to 63 months" in prison- even after considering Cohen's helpfulness to the Mueller Investigation.
